Terms of Service

These Terms of Service govern your use of EurekaWrite. EurekaWrite is an AI writing coach designed for Year 3–6 students preparing for the NSW Selective High School Placement Test. It is a study aid, not a substitute for a qualified teacher. Accounts must be created and supervised by a parent or guardian. Nothing in these Terms limits the consumer rights you have under the Australian Consumer Law.

1. About these Terms

These Terms of Service ("Terms") form a binding agreement between you and EurekaWrite ("EurekaWrite", "we", "us") in relation to your use of the EurekaWrite website at eurekawrite.com and the AI essay scoring service made available through it (the "Service").

By creating an account, submitting an essay, or otherwise using the Service, you confirm that you have read and accept these Terms and our Privacy Policy. If you do not accept them, please do not use the Service.

2. Who can use EurekaWrite

EurekaWrite is designed for Year 3–6 students (typically aged 8–12) preparing for the NSW Selective High School Placement Test.

The Service lets you submit essay text and receive an AI-generated score and feedback aligned to the six scoring dimensions used in the NSW Selective High School Placement Test Writing Assessment. The Service may also offer writing prompts, progress tracking, and writing guides.

The Service is a study aid. It is not an official assessment and is not affiliated with, endorsed by, or in partnership with the NSW Department of Education, Cambridge Assessment Admissions Testing, or any selective school. References to "NSW Selective" are descriptive of the style of assessment the Service is designed to support.

5. Free use and future pricing

At the time of this version of the Terms, EurekaWrite is offered free of charge. We may introduce paid features, subscriptions or usage limits in future. If we do, we will give you reasonable notice and the opportunity to decide whether you want to continue. Paid features will be governed by additional terms presented at the point of purchase.

You agree that you and anyone using the Service through your account will not:

7. Your content and intellectual property

You keep ownership of the essays you submit. The student remains the author of their own writing; EurekaWrite does not claim any copyright over student essays.

So that we can actually run the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit and process essay text and other content you submit, solely for the purpose of:

This licence ends when you delete the content or close the account, except to the extent we are required to keep copies to meet a legal obligation, to resolve a dispute, or in routine backups that are rotated out on a rolling basis.

We do not use your essays to train third-party AI models. See the Privacy Policy for how essay data is handled by the third-party scoring provider.

8. Our intellectual property

The EurekaWrite website, its layout, graphics, written guides, scoring prompts, feedback text, and software are owned by or licensed to EurekaWrite, and are protected by copyright and other intellectual property laws. You may use them for your own personal, non-commercial study. You may not:

References to third-party names, trademarks (including "NSW Selective", "NSW Department of Education", and any awarding body) are used descriptively to identify the assessment our Service is designed to support. All such trademarks remain the property of their respective owners.

9. AI scoring disclaimer

Short answer: Scores and feedback are generated by an AI model. They are approximate, may vary, and should not be treated as an official assessment or as a substitute for a qualified teacher.

10. Availability and changes

We try to keep the Service available and working well, but we do not promise that it will be uninterrupted, error-free, or available in any particular place at any particular time. We may modify, suspend, or discontinue features (including the whole Service) at any time, with or without notice. Where reasonable, we will give advance notice of significant changes that affect existing users.

11. Suspension and termination

We may suspend or terminate your access to the Service if we reasonably believe that you have breached these Terms, that continued access creates a legal or security risk, or that we are required to do so by law. Where practical we will give notice and an opportunity to fix the problem first. You can stop using the Service and close your account at any time. Sections of these Terms that by their nature should survive termination (including sections 7, 8, 9, 12–18) will continue to apply.

12. Consumer guarantees (Australian Consumer Law)

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Competition and Consumer Act 2010 (Cth), Schedule 2). Nothing in these Terms excludes, restricts or modifies any right or remedy that you have as a consumer under that law or any other law that cannot lawfully be excluded.

To the extent we are permitted to limit our liability for a failure to comply with a consumer guarantee in relation to services, our liability is limited (at our option) to:

You agree to reimburse us for reasonable losses, costs and expenses we suffer as a direct result of: (a) your breach of these Terms; (b) content you submit through the Service in breach of section 6 or section 7; or (c) your unlawful or infringing use of the Service. This clause does not apply to the extent the loss is caused by our own negligence or breach.

Our handling of personal information is described in the Privacy Policy, which forms part of these Terms. Please read it carefully — especially the sections on children and overseas disclosure.

16. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify account holders by email or via a notice in the Service. If you do not agree to the updated Terms, you should stop using the Service and close the account. Continuing to use the Service after an update constitutes acceptance of the revised Terms.

17. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the exclusive jurisdiction of the courts of New South Wales and the federal courts of Australia in relation to any dispute, except that either party may seek urgent injunctive relief in any court of competent jurisdiction.
