Terms of Service

These Terms of Service govern your use of EurekaWrite. EurekaWrite is an AI writing coach designed for Year 3–6 students preparing for the NSW Selective High School Placement Test. It is a study aid, not a substitute for a qualified teacher. Accounts must be created and supervised by a parent or guardian. Nothing in these Terms limits the consumer rights you have under the Australian Consumer Law.
1. About these Terms
These Terms of Service ("Terms") form a binding agreement between you and EurekaWrite ("EurekaWrite", "we", "us") in relation to your use of the EurekaWrite website at eurekawrite.com and the AI essay scoring service made available through it (the "Service").
By creating an account, submitting an essay, or otherwise using the Service, you confirm that you have read and accept these Terms and our Privacy Policy. If you do not accept them, please do not use the Service.
2. Who can use EurekaWrite
EurekaWrite is designed for Year 3–6 students (typically aged 8–12) preparing for the NSW Selective High School Placement Test.
- Accounts must be created by a parent or legal guardian who is at least 18 years old. By creating an account you confirm that you are the parent or legal guardian of the student whose writing will be submitted, and that you consent to EurekaWrite processing information about that student as set out in the Privacy Policy.
- Students may use the Service only under the supervision of the parent or guardian who created the account.
- You are responsible for the activity of anyone who uses the Service through your account, including your child.
- We may refuse to provide the Service, or close any account, where we reasonably believe these eligibility requirements are not met.
3. Your account
- We identify accounts by a parent/guardian email address. We do not use passwords. Please keep the inbox for that email address secure, because whoever controls it effectively controls the account.
- You must give us accurate information when creating the account. We ask that you identify the student by a nickname, not their real name.
- You may close the account at any time by contacting us at eurekawrite@haorix.com. Closing an account results in deletion or de-identification of account data as described in the Privacy Policy.
4. The Service
The Service lets you submit essay text and receive an AI-generated score and feedback aligned to the six scoring dimensions used in the NSW Selective High School Placement Test Writing Assessment. The Service may also offer writing prompts, progress tracking, and writing guides.
The Service is a study aid. It is not an official assessment and is not affiliated with, endorsed by, or in partnership with the NSW Department of Education, Cambridge Assessment Admissions Testing, or any selective school. References to "NSW Selective" are descriptive of the style of assessment the Service is designed to support.
5. Free use and future pricing
At the time of this version of the Terms, EurekaWrite is offered free of charge. We may introduce paid features, subscriptions or usage limits in future. If we do, we will give you reasonable notice and the opportunity to decide whether you want to continue. Paid features will be governed by additional terms presented at the point of purchase.
6. Acceptable use
You agree that you and anyone using the Service through your account will not:
- Submit content that you do not have the right to submit, or that infringes any third party's copyright, moral rights or privacy.
- Submit another person's work and pass it off as the student's own.
- Submit content that is unlawful, abusive, harassing, defamatory, obscene, sexually explicit, or that describes real-world harm to a child.
- Include in essay text any information that should remain private — such as the student's full name, home address, phone number, date of birth, school name, or medical details — other than as allowed by the writing task.
- Attempt to reverse-engineer, scrape, probe, overload or disrupt the Service, or bypass any rate-limiting or access control.
- Use the Service to generate content for the purpose of deceiving an examiner, teacher or assessment body, or in any way that contravenes the rules of an exam or school.
- Use the Service on behalf of someone other than the student associated with the account, unless each student has their own supervised account.
We may remove content or suspend accounts that we reasonably believe breach these rules.
7. Your content and intellectual property
You keep ownership of the essays you submit. The student remains the author of their own writing; EurekaWrite does not claim any copyright over student essays.
So that we can actually run the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit and process essay text and other content you submit, solely for the purpose of:
- providing the scoring, feedback, progress tracking and related features to your account;
- transmitting the text to the third-party AI provider identified in our Privacy Policy for scoring; and
- operating, securing, maintaining and improving the Service in aggregate (for example, analysing how scores behave across many essays, on a de-identified basis).
This licence ends when you delete the content or close the account, except to the extent we are required to keep copies to meet a legal obligation, to resolve a dispute, or in routine backups that are rotated out on a rolling basis.
We do not use your essays to train third-party AI models. See the Privacy Policy for how essay data is handled by the third-party scoring provider.
8. Our intellectual property
The EurekaWrite website, its layout, graphics, written guides, scoring prompts, feedback text, and software are owned by or licensed to EurekaWrite, and are protected by copyright and other intellectual property laws. You may use them for your own personal, non-commercial study. You may not:
- copy, republish, resell, or systematically extract our content;
- remove or obscure copyright notices; or
- use our name, logo or branding in a way that suggests endorsement, partnership, or affiliation without our written permission.
References to third-party names, trademarks (including "NSW Selective", "NSW Department of Education", and any awarding body) are used descriptively to identify the assessment our Service is designed to support. All such trademarks remain the property of their respective owners.
9. AI scoring disclaimer
- Scoring is produced by an AI language model (currently operated by OpenAI). AI-generated outputs can contain mistakes, omissions or inconsistencies.
- Scores and feedback are not an official assessment from the NSW Department of Education or any examining body, and do not predict the result of any real exam.
- The Service is not a substitute for professional teaching, marking or educational assessment. Students should discuss results with a qualified teacher or tutor where possible.
- Feedback may include example sentences or suggestions. These are teaching examples only; students should write in their own words and must not submit AI-generated text as their own work in any exam or school task.
10. Availability and changes
We try to keep the Service available and working well, but we do not promise that it will be uninterrupted, error-free, or available in any particular place at any particular time. We may modify, suspend, or discontinue features (including the whole Service) at any time, with or without notice. Where reasonable, we will give advance notice of significant changes that affect existing users.
11. Suspension and termination
We may suspend or terminate your access to the Service if we reasonably believe that you have breached these Terms, that continued access creates a legal or security risk, or that we are required to do so by law. Where practical we will give notice and an opportunity to fix the problem first. You can stop using the Service and close your account at any time. Sections of these Terms that by their nature should survive termination (including sections 7, 8, 9, 12–18) will continue to apply.
12. Consumer guarantees (Australian Consumer Law)
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Competition and Consumer Act 2010 (Cth), Schedule 2). Nothing in these Terms excludes, restricts or modifies any right or remedy that you have as a consumer under that law or any other law that cannot lawfully be excluded.
To the extent we are permitted to limit our liability for a failure to comply with a consumer guarantee in relation to services, our liability is limited (at our option) to:
- supplying the services again; or
- paying the cost of having the services supplied again.
13. Limitation of liability
Subject to section 12 above, and to the maximum extent permitted by law:
- The Service is provided "as is". We do not guarantee any particular result, score, improvement in writing, or success in the NSW Selective Placement Test or any other exam.
- We are not liable for any indirect, consequential, incidental, special, exemplary or punitive loss, or for loss of profits, revenue, goodwill, data, or opportunity, arising out of or in connection with the Service.
- Our total aggregate liability to you in connection with the Service (whether in contract, tort including negligence, statute or otherwise) is limited to AU$100, or, if you have paid us a fee in the 12 months before the event giving rise to liability, the total amount you paid us during that period — whichever is greater.
14. Indemnity
You agree to reimburse us for reasonable losses, costs and expenses we suffer as a direct result of: (a) your breach of these Terms; (b) content you submit through the Service in breach of section 6 or section 7; or (c) your unlawful or infringing use of the Service. This clause does not apply to the extent the loss is caused by our own negligence or breach.
15. Privacy
Our handling of personal information is described in the Privacy Policy, which forms part of these Terms. Please read it carefully — especially the sections on children and overseas disclosure.
16. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify account holders by email or via a notice in the Service. If you do not agree to the updated Terms, you should stop using the Service and close the account. Continuing to use the Service after an update constitutes acceptance of the revised Terms.
17. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the exclusive jurisdiction of the courts of New South Wales and the federal courts of Australia in relation to any dispute, except that either party may seek urgent injunctive relief in any court of competent jurisdiction.
